**General Terms and Conditions of Sale (GTCS)**

**1. Purpose**  
These General Terms and Conditions of Sale (hereinafter “GTCS”) govern all sales made through the website Soft & Cosy (hereinafter “the Site”), owned by **SARL SAPHIR**, registered under company number 90523663400010, with its registered office at 55 rue de Saverne, 67120 Molsheim, France.  
They apply to all sales concluded between the seller and any consumer (hereinafter “the Customer”) wishing to make a purchase via the Site.

**2. Products**  
The products offered for sale are described and presented with the greatest possible accuracy.  
However, photographs, texts, graphics, and product descriptions are for illustrative purposes only and are not contractually binding and do not engage the seller’s liability.

**3. Prices**  
Prices displayed on the Site are in euros (€) and include all taxes (VAT included), excluding any delivery charges.  
The seller reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time the order is placed.  
In the event of an obvious pricing error or typographical mistake, the seller reserves the right to cancel the order.

**4. Orders**  
Any order placed and validated on the Site constitutes full and unconditional acceptance of these GTCS.  
Once the order has been validated and paid for, a confirmation email will be sent to the Customer.  
The seller reserves the right to refuse any order from a customer with whom there is an ongoing dispute relating to a previous order.

**5. Payment**  
Payment is due immediately upon placing the order.  
The Customer may pay by credit/debit card or any other secure payment method offered on the Site (Shopify Payments, PayPal, etc.).  
All transactions are secure and processed by Shopify’s partner payment platforms.

**6. Shipping and Delivery**  
Products are shipped from our warehouses or partners located in India.  
Average delivery times are 10 to 20 business days, depending on the destination country.  
In the event of an unusual delay, the Customer will be informed by email.  
The seller shall not be held liable for delivery delays caused by the carrier or external factors (strikes, customs delays, etc.).

**7. Right of Withdrawal and Returns**  
In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from the date of receipt of the order to exercise their right of withdrawal without having to provide any reason.

Returned products must be in their original condition and complete (packaging, accessories, labels, etc.).  
Return shipping costs are borne by the Customer, except in cases of error on our part or defective product.  
Refunds will be processed within 14 days of receipt and verification of the returned items.

**8. Warranty and Liability**  
The seller warrants that the delivered products conform to the descriptions provided on the Site.  
In the event of a defective or non-conforming product, the Customer may request a replacement or a full refund.  
The seller shall not be held liable in the event of misuse of the product or failure to follow the care instructions provided.

**9. Customs Duties**  
For international deliveries, customs duties, import taxes, or other local taxes may be applied depending on the destination country.  
These charges are the sole responsibility of the Customer.

**11. Intellectual Property**  
All elements of the Site (text, images, logos, graphics, brand name, etc.) are protected by intellectual property rights.  
Any total or partial reproduction without prior written authorization is strictly prohibited.

**12. Applicable Law and Jurisdiction**  
These GTCS are governed by French law.  
In the event of a dispute, an amicable solution will be sought before any legal action is taken.  
Failing an amicable agreement, jurisdiction shall lie with the courts of the defendant’s place of residence.
